As set out within the PPG, there are specific circumstances where contributions for
affordable housing and section 106 planning obligations should not be sought from small
scale and self-build development. This follows the order of the Court of Appeal dated 13
May 2016, which give legal effect to the policy set out in the written ministerial
statement of 28 November 2014 and should be taken into account.
The announcement stated that contributions should not be sought from developments of
10-units or less, and which have a maximum combined gross floorspace of no more than
1,000 square metres (gross internal area), albeit in designated rural areas, local planning
authorities may choose to apply a lower threshold of 5-units or less.
Whilst we recognise the importance of delivering affordable housing, we consider the
policy should be amended so that the minimum threshold is 5 units in the AONB and 10
units elsewhere. Increasing the burden on small scale developers/self-builders will
ultimately slow delivery for the Council at a time when much greater levels of housing
needs to be delivered.
If affordable housing is indeed a key priority of the Council, it should be reflected within
policy 1 and a much greater emphasis on delivery of greenfield sites on the edge of
settlement boundaries.
