The Countryside and Rights of Way Act 2000 Section 89(2b) requires that local authorities ¡°shall have

regard to the purpose of conserving and enhancing the natural beauty of the AONB and prepare and publish

a plan which formulates the policies of the local authority for the management of the AONB and carrying

out their functions in relation to it¡±.

Graham Simpkin Planning believes that the allocation of a substantial housing site in the AONB at Pedham

Place does not demonstrate that the council has given proper consideration to this Duty of Regard.

In terms of detailed comments on the policy, the council should make reference to the following:

1. Consideration should be given to the economic and social needs of local communities;

2. Landscape scale biodiversity networks

3. Landscape character assessment and recommendations;

4. Character of rural lanes.

The policy or the supporting text should be clearer about the setting of AONB and the relevance of the duty

of regard to the purposes of the AONB in such cases.
