Until the whole plan viability assessment is published we cannot comment on the fundamental soundness of this policy. However, we would like to highlight the change in government policy in relation to viability. The NPPF and PPG place much greater emphasis on the need for local plans to set realistic expectations for the delivery of affordable housing within residential development. Policy 9 – Provision of affordable housing proposes a financial requirement for affordable housing from small sites. It would not be appropriate to require contributions in this way if it would mean sites were unviable and as a result could affect the delivery of the OAN. Any such approach would need to be supported with up to date viability evidence.

Para. 5.21 states "It is considered that, subject to viability testing, a target of 40% affordable housing for all suitable sites is realistic and achievable in light of the evidence, and will go some way in meeting the identified affordable housing need." Tonbridge and Malling has concerns over including a target and percentages of affordable housing when this has yet to be subject to viability testing, which may demonstrate that such a figure is undeliverable.

Either the Plan requires for provision of affordable housing or it does not. If a Financial Contribution is the type of provision required (presumably to build elsewhere) – then no affordable housing will ever be built (in line with schools, doctors, dentists etc – promised but cash provided instead). In the case of less than 5 houses the affordable houses financial contribution is (presumably) in addition to any CIL payment and effectively another levy?
